Landlords in Gauteng have been warned that they are not permitted to make profit from the energy usage of their tenants.

They may not  transfer Johannesburg City Power's service cost of R385 to the tenant,  which the metro only charges the landlord for,  the Gauteng Rental Tribunal found last month.

According to the tribunal a landlord violates Gauteng's regulations on unfair practices when he charges "service fees" in addition to the monthly electricity consumption of the tenants.

This practice is considered making a  profit for the landlord to which he is not entitled, the tribunal found.

"In order for these services fees the landlord has to be possession of a license for the distribution of electricity, which he did not," said the statement.

Under the regulation "the landlord has to provide water, electricity or gas to tenants and the tenant has to be charged for the exact amount of services used in the unit."

Teboho Mosikili of the Socio-Economic Rights Institute (Seri), representing 80 tenants in the case, said the R385 tenants had to pay was for monthly service charges, not for electricity consumption.
